TERMS AND CONDITIONS OF USE – MIXTAX

Welcome to Mixtax. These Terms and Conditions of Use ("Terms") govern the access and use of the Mixtax mobile application and its associated services.

By creating an account or using the app, you expressly agree to these Terms. If you do not agree, you must not use the platform.

1. THE SERVICE

Mixtax is a technology platform that acts as an intermediary, connecting:

  • Passengers: Users seeking private transportation services.

  • Drivers: Independent service providers offering transportation.

Important: Mixtax does not provide transportation services and is not a carrier. The contract for transportation is strictly between the Passenger and the Driver.

2. ELIGIBILITY AND REGISTRATION

To use Mixtax, you must:

  • Be at least 18 years old.

  • Provide accurate, current, and complete information during registration.

  • Maintain the security of your login credentials. You are responsible for all activity on your account.

3. USER CONDUCT

Users agree to:

  • Treat other users (Drivers/Passengers) with respect and professional courtesy.

  • Not use the service for any illegal or unauthorized purpose.

  • Comply with all local traffic laws and safety regulations.

  • Drivers must maintain a valid driver’s license, vehicle insurance, and all legal permits required by local authorities.

4. PAYMENTS AND FEES

  • Fares: Estimated fares are displayed before the trip begins. Final values may vary based on route changes, traffic, or wait times.

  • Processing: Payments are processed via third-party gateways. Mixtax does not store full credit card data.

  • Cancellations: Cancellation fees may apply if a trip is cancelled after a Driver has accepted the request or reached the pickup location.

5. LIMITATION OF LIABILITY

  • Service Availability: Mixtax provides the app "as is." We do not guarantee that the service will be uninterrupted or error-free.

  • Third-Party Conduct: Mixtax is not liable for the conduct, whether online or offline, of any user of the platform.

  • Damages: To the extent permitted by law, Mixtax is not liable for indirect, incidental, or consequential damages resulting from the use of the app.

6. DATA PROTECTION

Your privacy is important to us. The collection and use of personal information in connection with the services are described in our Privacy Policy, which is an integral part of these Terms.

7. INTELLECTUAL PROPERTY

All rights, titles, and interests in the Mixtax app, including logos, software, and interface design, are the exclusive property of Mixtax. Users are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

8. TERMINATION

Mixtax reserves the right to suspend or terminate your account at any time, without prior notice, if:

  1. You violate these Terms.

  2. Your behavior poses a safety risk to other users.

  3. Your account shows fraudulent activity.

9. MODIFICATIONS

We may update these Terms from time to time. If we make significant changes, we will notify you through the app or via email. Continued use of the service after such changes constitutes your consent to the updated Terms.

10. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes arising from these Terms shall be resolved in the courts of the city where the company is headquartered, unless otherwise required by consumer protection laws.
